1. Acceptance of Terms

By downloading, installing, or using Luminate (“the app,” “we,” “our”), you agree to be bound by these Terms of Use. If you do not agree, do not use the app.

2. Description of the App

Luminate is a personal mental health journaling application designed to help you track your mood, journal your thoughts, and reflect on your emotional wellbeing. The app includes AI-assisted conversations, progress tracking, and gamification features.

3. Not a Medical Service

IMPORTANT: Luminate is not a medical device, clinical service, or substitute for professional mental health treatment.

The app is for personal wellness and self-reflection purposes only.
AI-generated responses are not therapy, clinical advice, or diagnosis.
If you are experiencing a mental health crisis, suicidal thoughts, or an emergency, please contact emergency services (911) or a crisis line immediately (e.g., 988 Suicide & Crisis Lifeline in the US).
Always consult a qualified mental health professional for clinical concerns.

4. Eligibility

You must be at least 13 years of age to use Luminate. By using the app, you confirm that you meet this requirement. Users under 18 should have parental consent.

5. Subscriptions and Purchases

5.1 Luminate Pro

Luminate offers a premium subscription (“Luminate Pro”) that unlocks additional features. Subscription pricing and billing intervals are displayed at the time of purchase within the app.

5.2 Billing

Subscriptions are billed through your Apple ID via the App Store.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
You can manage or cancel your subscription in your Apple ID account settings.

5.3 Refunds

All purchases are subject to Apple’s refund policy. We do not control or process refunds — contact Apple Support for refund requests.

5.4 Restore Purchases

You can restore previous purchases at any time using the “Restore Purchases” option in the app.

6. Acceptable Use

You agree not to:

Use the app for any unlawful purpose.
Attempt to reverse-engineer, decompile, or extract the app’s source code.
Use the AI conversation feature to generate harmful, abusive, or illegal content.
Misrepresent your identity or impersonate others.

7. Intellectual Property

All content within Luminate — including but not limited to design, graphics, characters, text, and software — is the intellectual property of the developer. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

8. AI-Generated Content

The AI Conversation feature is powered by OpenAI. AI responses are generated automatically and may not always be accurate, complete, or appropriate. We are not responsible for the content of AI-generated responses. Do not rely on AI responses for medical, legal, or professional advice.

9. Privacy

Your use of Luminate is also governed by our Privacy Policy. By using the app, you consent to the data practices described therein.

10. Disclaimer of Warranties

Luminate is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, the developer of Luminate shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the app, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from these Terms or your use of the app shall not exceed the amount you paid for the app in the twelve (12) months preceding the claim.

12. Termination

We reserve the right to suspend or discontinue the app at any time. You may stop using the app at any time by uninstalling it. These Terms remain in effect after termination to the extent applicable.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the developer is located, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of Luminate after changes are posted constitutes your acceptance of the revised Terms. We will update the “Effective Date” at the top of this page when changes are made.
